Companies are the main vectors of economic growth. This is the reason why the Organization for the Harmonization of Business Law in Africa (OHADA)1 , whose primary objective is the economic development of the African continent, gives priority to stability and business sustainability. Considerable efforts are made by the OHADA legislator, like their counterparts in other community organizations2, and African national legislators. The rules have changed significantly, marking a real revival of applicable law to meet the expectations of the business community. Successive evaluations of these legislative and regulatory actions, conducted by international organizations, have moreover hailed the undeniable intrinsic contributions of this mechanism in the conduct of the economic development process; the latter passes, without any doubt, by the constitution of a strong private sector.
